When the government acquires property compulsorily under the Land Acquisition (Just Terms Compensation) Act 1991 (NSW), you are entitled to "just terms" compensation — which means the market value of the land, plus allowances for disturbance, solatium (inconvenience), legal costs, and other specified heads of compensation.
The acquiring authority will engage its own valuer to assess compensation. You are entitled to obtain your own independent valuation to ensure you receive the full compensation the Act entitles you to. In many cases, the acquiring authority's initial offer significantly undervalues the property, and an independent valuation is essential for negotiating fair compensation.
The just terms process:
- You receive a Notice of Proposed Acquisition (NOPA)
- The acquiring authority makes an offer of compensation
- You may accept the offer or negotiate — supported by your independent valuation
- If no agreement is reached, the matter is referred to the Land and Environment Court for determination
