In NSW, transfer duty (stamp duty) is payable on the higher of the purchase price and the unencumbered market value of the property. Where a property is transferred for less than market value — such as in a family transfer, a deceased estate distribution, or a business restructure — Revenue NSW may require an independent market valuation to confirm that the correct amount of duty has been calculated.
When a stamp duty valuation is required:
- Related party transfers: Properties transferred between family members (e.g., parent to child, between siblings) often change hands at below-market value. Revenue NSW may assess duty on the true market value rather than the transfer price.
- Deceased estate distributions: When property from a deceased estate is transferred to beneficiaries, duty is assessed on market value.
- Business restructures: Property transferred as part of a business restructure or corporate reorganisation may require a valuation for duty purposes.
- Concessional grants: Where a purchaser claims a first home buyer concession or exemption, Revenue NSW may require evidence that the property value falls within the applicable threshold.

Objecting to a Revenue NSW assessment: If Revenue NSW has assessed duty on a value you believe is incorrect, we can prepare a valuation to support an objection. Our certified valuers are experienced in preparing and, where necessary, defending their assessments in duty objection proceedings.
